No sub-leasing of slips will be permitted except upon prior permission of the slip owner and SHYC approval.

Owner/Lessee must comply with lease requirements prior to mooring their vessel at SHYC. Failure to do so will result in financial sanctions and/or ejection from the marina.

The Owner/Lessee shall be responsible for damage which he may cause to other boats in the Marina or for damage to any structure or property.

The slip owner's sole obligation under this agreement shall be to provide the boat slip hereinafter referred to. The Owner and SHYC shall under no circumstances be responsible for any losses or damages to boats or personal property in the Marina caused by Owner/Lessee. The Owner and SHYC will not be held responsible for any damage resulting from fire, theft, storm damage, tide, wind or other conditions beyond our control, nor do we carry insurance against damage.

The Owner/Lessee agrees to have his vessel covered by a full marine insurance policy (hull, indemnity and liability coverage) a copy of which shall be supplied to the SHYC. Owner/Lessee hereby releases and discharges the Owner and SHYC from any and all responsibility or liability for injury (including death) loss or damage to persons or property in connection with the Owner's docking facility or the Marina. This release and discharge shall cover without limitation any loss or damage resulting from the Owner's employees parking or hauling Owner/Lessee's boat, vandalism, theft, fire, hail, high/low water, wind, collision, ice, rain, or any act of God.

The Owner/Lessee agrees that should his conduct or breach of lease or violation of a rule require ejection, he will be responsible for any and all costs incurred by SHYC for his boat's removal from the marina.

The Owner/Lessee agrees to keep, save and hold Owner and SHYC harmless from any and all damages and liabilities for anything and everything whatsoever, arising out of the occupancy by Owner/Lessee's boat on Owner's and SHYC's premises.

No outside contractors or persons other than the Owner/Lessee whatsoever shall be allowed to repair boats without first obtaining permission from SHYC. If permission is granted, the Owner/Lessee must provide a certificate of Liability Insurance and Workmen's Compensation Insurance before work can be started. Please check with the Dock Master for permission to work on your boat. There are certain types of work that are hazardous to all occupants and the Marina property and are absolutely forbidden, such as carburetor and fuel related work.

If the Owner/Lessee wants to sell their boat, for the Marina's security, SHYC requires the prospective boat buyer to be accompanied by a representative of the boat owner and notify the Dock Master, prior to entering the Marina. These procedures are taken to insure other Marina occupants that there will be no unauthorized people wandering through the Marina or their boat.

If a shore power plug(s) is plugged into the Marina's shore power supply, the Slip Owner will be charged a $150 fee for seasonal power usage. Air conditioning units can not be left running during extended away times, more than two days (including humidity control settings). Violation of this rule will result in additional charges.

Owner/Lessee shall not store supplies, materials, accessories or debris upon any dock or walkway and shall not construct or modify thereon any lockers, chests, cabinets, steps, ramps or similar structures except with permission of Owner and written approval of SHYC. If permitted, no dock box shall exceed 30" deep, 30" high, 72" long and shall be made of fiberglass and must be white. There shall be no rugs nailed to the docks or wooden structures. No chairs or objects are to be placed on the docks or walkways that interfere with normal passageways.

No flame, torch, or open fire permitted at any time within 50' radius of the boats, docks, buildings, or fuel tanks, except in designated areas.

Dogs and other pets are not allowed to run loose on the Marina or Condo properties. No pets are allowed in the pool area whatsoever. Pets are permitted on leashes only and are to be walked in designated areas. Pet owners are responsible to remove all droppings. All pets are required to have necessary inoculations and records of which provided if requested. Pets exhibiting any aggressive behavior will not be allowed on SHYC property.

Operator does not guarantee that electrical and water service shall be continuous. The electrical and water outlets on the dock are there for occasional use and may be interrupted occasionally.

Owner and/or SHYC shall enter the Owner/Lessee's boat only in the event of an emergency and only if authorized by the Owner/Lessee.

Each slip is permitted one parking space as available. Guests are required to utilize the additional parking areas available on the municipal streets adjacent to the marina.

Six (6) pool passes are issued per slip. The issued badges must be visible while in the pool area. All passes issued are for the slip's occupant. They can not be lent, sold, or otherwise redistributed to anyone other than the slip's occupant. The slip's occupant must be present if they authorize guests to use a pool pass. The posted pool rules MUST be obeyed at ALL times. A "Pool Rules" sheet is distributed with the pool passes. Violation of pool rules will result in pool pass revocation or ejection from the marina. Children under 16 years old MUST be accompanied by an adult at all times.

Owner or SHYC reserves the right to terminate the slip agreement if the Owner/Lessee or their guests use loud or abusive language or cause a disturbance to other occupants.

There will be no fueling of boats in the Marina. The discharge of oil, spirits, flammable liquids, oily bilges, or any other substance prohibited by law is prohibited in the Marina. In the event of an occurrence, the Owner/Lessee is solely responsible for its clean up and any and all costs/fines incurred.

NO DISCHARGE ZONE: The discharging of marine heads, holding tanks, or any sanitary waste is not permitted and strictly enforced. Any violations will result in immediate expulsion from the marina. A marine pump out station is located at the marina and assistance can be provided if necessary.

No crabbing or fishing allowed from the docks or finger piers, except in designated areas. There will be no cleaning of fish on docks. All fish will be cleaned at the designated fish cleaning station. All fish carcasses must be disposed of in the appropriate manner approved by SHYC.

The marina dumpster is for the exclusive use of SHYC boaters to dispose of standard on-site trash. The disposal of trash generated outside of SHYC is not permitted. Oil and hazardous materials are not to be disposed of in the dumpster. All recyclable materials are to be disposed of in the provided container per instructions listed on the container.

In the event of any breach by the Owner/Lessee of any of the terms of this agreement, the SHYC Rules, the Owner or SHYC may terminate this lease and the Owner/Lessee forfeits any and all claims for refund of any sums paid there under to the date of such breach or termination.

SHYC reserves the right to amend the Rules at any time as deemed necessary.
